Terms of Service

1. Who we are

Traceflat (traceflat.com, "the service") is run by Viktoriia Romanova PR Subotica, Borivoja Misica 86, 24000, Subotica, Serbia, MB00000, PIB 00000 ("we", "us"). Contact: support@traceflat.com.

By using the service you accept these terms. If you do not accept them, do not use the service.

2. The service

• The floor plan editor (2D drawing, 3D view, furniture catalog, PNG and project file export) is free and works without an account. Projects you keep without an account are stored in your browser only.
• With an account you can keep projects in the cloud: 1 cloud project free, packs add more.
• The AI assistant draws a plan from a photo and changes a plan from typed requests. It is an AI system: its answers and drawings are generated automatically. It is paid with credits.
• PDF and DXF export is available while you have an active purchased pack.
• The service runs in a current browser on a computer (Chrome, Edge, Firefox or Safari). Drawing is made for a mouse or a touchpad; on phones some functions do not work well.

3. Your account

You sign in with a link sent to your email or with Google. Keep access to your email account safe: whoever can open it can sign in as you. You must be at least 16 years old, or have the consent of a parent or guardian, to make an account and to buy. One account is for one person.

4. Credits and packs

• Credits are sold in one-time packs. There is no subscription and nothing renews by itself.
• A pack starts when it is paid for. Its credits, its cloud projects and the export it opens last for the number of months shown with the pack. Credits left after that expire.
• The price of each action in credits is shown before you start it (now: a plan from a photo 10 credits, a typed request 1 credit). A run of the AI is charged when it produces a result or when you stop it; a run that fails because of an error on our side is not charged.
• When you have more than one pack, credits are taken from the pack that expires first.
• Credits have no cash value, cannot be transferred to another account and cannot be exchanged for money, except as described in the refund policy.
• When a pack ends, nothing is deleted: cloud projects over your remaining limit become read-only (you can still open, export and delete them).
• Free credits we give (for example when you sign up) may have their own validity and are not refundable.

5. Prices and payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's buyer terms apply to the payment.

The price, the credits and the validity of each pack are shown before you pay. Prices include VAT in the EU, the UK and other countries where prices are shown with tax; elsewhere (such as the US) sales tax is added at checkout.

After the payment we confirm the purchase by email, with the pack, its validity and the conditions you accepted.

6. Starting right away and refunds

Before paying you confirm that you want the pack to start right away, and that once you use any of its credits the pack can no longer be refunded. If you are a consumer in the EU or the UK, this is your express consent to the immediate supply of digital content and your acknowledgement that you lose the right of withdrawal once the supply has begun, that is, once you use a credit of the pack. Until then you can get your money back within 14 days: see the refund policy.

7. Results of the AI

The AI reads photos and requests and can make mistakes: misread dimensions, missed doors or windows, a wall in the wrong place. It says where it guessed, but you are responsible for checking the result. A plan made with the service is a drawing to work with, not a surveyed measurement or a design document: do not use it for construction, purchase or legal decisions without checking it on site or with a qualified professional. A result you do not like is not by itself a reason for a refund of the credits it used.

8. Your content

Your plans, photos and texts remain yours. You give us the right to store and process them only to run the service for you, including sending them to the company that runs the AI model for a request you make (see the privacy policy). Upload only material you have the right to use, and no personal data of other people that you have no right to share.

9. Acceptable use

Do not break the law with the service, attack or overload it, try to get around its limits or payments, use it to build a competing service, or access it by automated means other than the app itself. We may suspend an account that does; if we do so without a breach on your side, we refund the unused credits of its active packs.

10. Changes and availability

We improve the service and may change or remove features. We aim to keep it available but do not promise uninterrupted operation. If we shut the service down, we will tell every account by email and in the service at least 30 days before the closing date, and you will be able to export your projects during that time. The unused credits of your active packs are refunded if you ask for it before the closing date (reply to the notice or write to support@traceflat.com): the price of each pack in proportion to its credits left.

11. Liability

The service is provided as it is. To the extent the law allows, we are not liable for indirect losses or for decisions made on the basis of a plan made with the service, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability for intent or gross negligence, for injury to life or health, or any other liability that cannot be limited by law, nor your rights as a consumer under the mandatory law of your country.

12. Ending the use

You can stop using the service at any time and delete your account yourself (account menu → Delete account) or ask us at support@traceflat.com. Deleting the account ends its packs; their unused credits are not refunded, except within the refund policy.

13. Changes to these terms

We may change these terms. Substantial changes are announced in the service or by email before they apply. The terms you accepted with a purchase keep applying to that pack.

14. Law and disputes

These terms are governed by the law of the Republic of Serbia. If you are a consumer, you keep the protection of the mandatory law of your country of residence and may bring a claim in its courts. Please write to us first: most problems are solved by email.
